VIRTUAL COURT HEARING
Background
Ever since the nationwide lockdown on 24 March, 2020 due to the COVID-19 pandemic,
like most of the offices of the Government, the Authority and its officers started working
from their homes. With a view to keep the continuity of the work in the desirable manner,
the Authority decided to meet every day through videoconferencing to take stock of the
pending matters that require the attention of the Authority and to suitably guide its
officers.
The Authority had its first meeting through video conferencing on 13th April in which it
was decided to conduct the hearings of the complaints through video conferencing
when the lockdown conditions are relaxed. In accordance with the social distancing
guidelines laid down by the Ministry of Home Affairs, Government of India and the
Government of Uttar Pradesh, it was decided by U.P. RERA under the provisions of the
Section-37 of the Real Estate (Regulation and Development) Act, 2016, to issue necessary
guidelines for conducting the court hearing of the cases, filed under Section 31 of the Act
before the Authority and the Adjudicating Officer, through video conferencing.

Preparation
It is pertinent to mention that the Authority has implemented e-Courts system with effect
from 2nd March 2020, thus moving towards the digital way of managing the complaints
in a transparent and timely manner.
In order to make it easy for the parties to attend the court proceedings through this new
practice of hearings through VC, detailed guidelines about the virtual court hearing were
prepared and were issued by the Authority vide its order dated 18th May 2020.
