     Importance of the forum


     Under  the RERA Act,  a  homebuyer  may lodge  a  complaint  against  the  promoter  of  a
     registered or a real estate agent for a default on the terms of their contractual
     commitments. But at the conciliation forum, the buyer/promoter does not have to worry
     about legal fall out of court hearings and proceedings. The applicants can get a resolution
     to their problems related to delay in possession, changes in construction plans, additional
     charges, or lack of facilities promised, including parking space, storage space, or elevator in
     amicable manner.  Also, for the promoter, the forum  provides a platform  for sharing its
     concerns like funding issues, land disputes, competent authority related disputes,
     court-stays etc. The promoter may also narrate the circumstances which led to the home
     buyer having the grievance and arrive at a solution in presence of the conciliator which is
     acceptable to both the parties. It also gives the promoter an  opportunity to  truly
     understand the challenges faced by the home buyer, thus strengthening the accord
     between the parties leading to the resolution of not just the current points of concern but
     also any future issues that may surface between them. Thus, the  establishment of a
     conciliation forum not only takes the load off the RERA Benches but also brings about a
     speedy and enduring solution to the issues faced by the homebuyers. Another advantage
     of the conciliation forum is that it promotes face-to-face discussion over the contentious
     issues.



     The Bottom line


     As of now, for the Conciliation Forum at NCR Regional Office, 256 matters are waiting to be
     taken up by the conciliation forum. The UP RERA conciliation forum has thus far, achieved
     a staggering success rate of 81%, having 640 cases registered online, out of which 324 have
     been settled, whereas out of 286 cases transferred from the benches, 166 have been settled.
     Notably, the promoters such as Supertech Ltd,  Gaursons  Ltd have  shown tremendous
     enthusiasm towards the concept and implementation of the Conciliation Forum. In
     Conciliation Forum at Lucknow Headquarters, out of 112 cases registered, 99 have been
     settled through the forum, whereas out of 204 cases  transferred by the Benches, 176 have
     been  amicably settled through the conciliation  forum.  Conciliation  forums  have  thus
     emerged as successful alternative mechanisms for the amicable settlement of disputes
     between the home buyers and the promoters.
